Learning objectives

The course is designed to teach the student the fundamental concepts pertaining
the special part of the Penal Code, with reference both to the “juridical objects” and
the “general categories” of the special part; the goal is to allow the student which
has already studied the general part of Code to apply those more general concepts
and to understand the “political dimension” of the Criminal law, which can mostly be
seen in the special part. The special attention devoted to sex crimes and crimes against minors, but also prostitution-related crimes, stalking and other offences against moral self-determination is geared towards the teaching of a method of analysis of the single provisions and to have the student learn interpretation
techniques of the same provisions.

Prerequisites

Istituzioni di diritto privato, Istituzioni di diritto romano and Diritto penale I must have
been successfully passed to take this course.

Course unit content

The course is concerned with, on one side, the special part of the Penal Code; in
this respect, the most important introductive concepts regarding the special part of
the Code will be analyzed, with particular reference to the specific goals of
protection, meaning that the “juridical objects” (beni giuridici) of the provisions will
be analyzed. On the other side, special attention will be given to sex crimes and
crimes against minors (with respect to their correct growth and development),
prostitution-related offences, stalking and other crimes against moral selfdetermination.

Teaching methods

Lectures. For the students which regularly attend classes moot court trials will be
organized (under tutor supervision). The schedule will be agreed upon at the
beginning of the year.

Assessment methods and criteria

Oral exam. There will be no intermediate test, since students will be already
involved in moot court trials. The goal of the final oral exam will be to verify, in the
first place, the understanding of the general concepts pertaining the special part of
the Penal Code, by asking open-ended questions whose answers should reach all
the relevant elements of the particular topic. Moreover, the second part of the exam
will be pertaining the topic of the second textbook and a more specific question will
be asked. Finally, if a student participated in moot court trial, a question will also
pertain that part of the course.
