Learning objectives

Teaching aims to develop a good knowledge of the fundamental elements of environmental matter in the students. At the end of the training activity, students should have acquired and developed a self-sufficient argumentative and judgmental ability to study and analyze the main aspects of environmental law. In particular, students are expected to be able to: 1) know the general discipline in the environmental field; Know the source system and the relationship of interaction between internal norms and supranational rules that characterize matter; Understand the principles of international matrix (such as the principle of sustainability, the "polluter pays" principle, the precautionary principle) that allowed the establishment of the legal environment; To know the main environmental definitions; Read and understand a case law; Interpret the rules systematically, according to the doctrinal and jurisprudential guidelines (knowledge and understanding skills). 2) Apply the notions acquired to concrete situations, be able to develop autonomous argumentative pathways suitable for the definition of practical cases (ability to apply knowledge and comprehension). 3) Being able to deal with real issues in the field of the environment, including knowledge of legal notions (autonomy of judgment). 4) Use an appropriate and specific language of the subject (communicative skills). 5) Analyze different cases of reality, through the filtering of the notions received, to reach assessments of compliance with the normative paradigm of the cases dealt with (learning ability).

Prerequisites

The teaching of the administrative law and its examination of profit are conducive to teaching, and related exams, scientific-disciplinary sector IUS/10, including environmental law

Course unit content

The aim of the teaching is to study the general discipline of environmental law and to deepen some specific areas of matter. The course is structured in three lessons. The first cycle of lessons provides the introductory notions needed to study and understand environmental law. The basics concern the study of the evolution of environmental law, the analysis of internal and Community sources, the illustration of constitutional principles and administrative procedures in the field of the environment. The second cycle of lessons is aimed at addressing peculiar aspects of this area of law such as the principle of sustainable development, responsibility for environmental damage, environmental risk assessment, environment and territory. The third cycle of lessons is devoted to the analysis of particular issues such as waste and renewable energies.

For students attending:
The topics developed during the lessons refer to the notions contained in the reference text: "Introduzione al diritto dell'ambiente" by A. Crosetti, R. Ferrara, F. Fracchia - Laterza - Latest Edition.
In order to discuss some of the topics of particular interest, the professor will take part in the classroom and then upload some sentences to Elly. Attending Students will have to choose two sentences, mentioned above, uploaded by the Teacher on the Elly Platform, and expose them orally. It is essential to consult the Environmental Code and the relevant European Directives on this matter.
For Non-Attending Students the reference text is "Introduzione al diritto dell'ambiente" by A. Crosetti, R. Ferrara, F. Fracchia. All chapters. In addition, non-attending students may choose (as optional option) a sentence to be displayed orally, among those uploaded on the Elly Platform by the Teacher. It is essential to consult the Environmental Code and the relevant European Directives on this matter.

Teaching methods

Teaching will be done by alternating oral lessons for 30 hours, in active learning mode, for 6 o'clock. The frontal lessons will focus on studying and discussing baseline and introductory notions, analysis Internal and European sources, illustrating key environmental issues and addressing peculiar aspects of this area of ​​law such as renewable energies, waste, and environmental risk assessment. Lectures in active learning will focus on collegial analysis of some cases and related jurisprudential judgments. For students attending the lectures discussed in the classroom and teased by the Teacher on the Elly platform, they form an integral part of the program. For non-attended students, there is a possibility to illustrate a choice of choice between those made available by the Teacher on Elly. All teaching activity will be conducted by privileging dialogue and collegial comparison.

Assessment methods and criteria

STUDENTS ATTENDING: learning and degree of preparation reached will be verified through a structured oral exam through the proposition at least three questions, with reference to the teacher's lecture notes (whose individual chapters will be uploaded from time to time on the platform Elly), the Environmental Code and the two pronunciations selected by the student, as part of case law decisions discussed by the teacher in the classroom and to be Elly. Final assessment, carried out in oral mode with rating expressed in thirtieths, is aimed at assessing the overall level of knowledge of institutes, the source system and procedural notions on the subject, acquired by the student during the classes. The final test also aims to evaluate the student's ability to use appropriate legal language, to analyze the different cases of reality through the filter of knowledge gained and to interpret the rules with systematic method. The threshold of sufficiency will be reached where the student will be able to demonstrate knowledge and understanding of the system of sources, definitions and the main proceedings in environmental matters, together with application expertise with regard to the autonomous and reasoned exposition of minimum two judgments, as identified by the student among those analysed in the classroom by the teacher and be Elly. Below these levels, final oral evidence may not be sufficient. The vote will be announced immediately on completion of the test.
STUDENTS NOT ATTENDING: learning and degree of preparation reached will be verified through a structured oral exam through the proposition at least three questions, with reference to the text "environmental law" by Giampaolo Rossi, g. Giappichelli Editore, Torino, latest edition, in all its parts (NO CHAPTER EXCLUDED), the Environmental Code and, if the student wishes to deepen a Townie theme by selecting a pronunciation of law among those uploaded to Elly by teacher , with reference also to the pronunciation choice. Final assessment, carried out in oral mode and expressed by vote out of The vote will be announced immediately on completion of the test. If due to the persistence of the health emergency it would be necessary to take the exams remotly, the exam will consist of an oral-distance examination by Teams platform.
