Learning objectives

Knowledge and understanding: the study of administrative law leads the student to learn about the organisation and administrative activity, administrative power and the relationship between the administration and the administered, as well as to understand the key legal principles and concepts of the subject.
Ability to apply knowledge and understanding: the study aims at fostering the acquisition of the applicative profiles of the subject, in connection with a conscious use of the critical tools typical of the discipline of substantive administrative law. In particular, particular care will be taken during the course to examine case law and to discuss copious case studies, so as to enable the student to acquire practical knowledge and interlocutive skills through the use of legal language.
Autonomy of judgement: through the study of administrative law the student can acquire flexibility, initiative, aptitude for problem solving, the ability to analyse even complex documents and to evaluate solutions also with a view to their application. Autonomy of judgement is pursued both through the analysis and reading of texts of doctrine (in its evolution) and normative texts and judgements.
Communication skills: through the course, the student learns to communicate information, ideas, problems and solutions relating to administrative law topics. Communication skills will be stimulated through lectures, during which there will be maximum involvement of the students.
Learning skills: through the study of administrative law, the student learns the rules and institutes of the discipline. On this basis, the student will acquire skills and critical capacities capable of guaranteeing him/her access to further theoretical and practical study.

Prerequisites

It is necessary to have passed the Institutions of Private Law, Institutions of Roman Law and Constitutional Law examinations.

Course unit content

The aim of the course is to provide students with the fundamentals of Italian substantive administrative law and to deepen their knowledge of some of the most important institutions in which the discipline of administrative action is embodied. The course is divided into four parts. The first part is devoted to the general principles of administrative law, the system of sources and public figures as well as organisational models (organisational structures and organisational relations). Then, the topics of administrative power and subjective legal situations (objective rights and legitimate interest) as well as the relationship between the administration and the administered are examined in depth. Further in-depth study is devoted to the act and the procedure, defects
of the act and its remedies as well as the administrative liability regime. The third part of the course covers public services and goods as well as public contracts and finance. Finally, the last part of the course focuses on the main lines of the administrative justice system.

Teaching methods

Lectures will be given in person and will aim at the maximum involvement of the students, so that they are not only a phase of illustration of the subject, but also a time of learning and preparation for the examination.
During the course of the year, exercises and seminars will be held on specific topics, mainly by reading and examining the most recent and important
judgments on the subject.
The teaching material indicated in the lectures will be made available on the Elly platform.

Assessment methods and criteria

The final examination will consist of an oral exam, which tends to consist of a few questions for each part of the course: the questions are aimed at understanding whether the student has acquired sufficient knowledge of the fundamental aspects of each part.
