Integrated course unit module: CLIMATE CHANGE AND SUSTAINABLE DEVELOPMENT LAW

Learning objectives

The course aims to provide the student with the fundamental notions on climate change and sustainability law.
With specific reference to the Administrative Law module, the aim of the course is to provide the student with the basic notions on: the principle of sustainable development and energy transition. The relative normative discipline will also be studied in depth and pertinent doctrinal and jurisprudential contributions will be analyzed.
At the end of the module, the student must have acquired the ability:
- to recognize, interpret and correctly apply the principles of environmental and energy administrative law;
- to know and correctly apply the relevant national and supranational law rules;
- to independently investigate the issues relating to the principle of sustainable development in environmental administrative law;
- to apply the acquired knowledge to concrete cases and to support their theses with appropriate language properties and arguments.

Prerequisites

Students are strongly advised to take the course after having taken the exams of: Constitutional law; Administrative law; Public international law; European Union law; Tax law.

Full programme

during the 6 hours of lessons the themes connected to the principle of sustainable development and the energy transition will be developed.
In particular, it will be noted that the energy transition requires changes on different profiles: not only technological, but, as far as it is concerned, also organizational and institutional ones.

Teaching methods

The Administrative Law Module six hours of lectures in which interactive moments with students will be included, consisting mainly in the analysis and discussion of documents available on the Elly platform.

Assessment methods and criteria

The exam is written and consists of submitting students to a multiple choice test and two open questions.
Knowledge and understanding will be assessed with 10 multiple choice questions, aimed at verifying effective knowledge of the fundamental concepts relating to the five modules.
The ability to apply knowledge and autonomy of judgment will be ascertained by inviting the student to discuss the general notions in the light of two hypothetical cases.
The ability to communicate will be ascertained by evaluating the student's ability to use the appropriate technical terminology and correctly apply particular rules or principles.
Learning skills will be assessed through an overall assessment of the answers given to the test questions.
In the event that the health emergency continues and depending on its evolution, the exam may take place in presence, in mixed mode (i.e. in presence, but with the possibility of support even remotely for students who request it from the Teacher), or only online for everyone (at a distance). The chosen method will be promptly notified on the Esse3 system in advance of the exam.
