Learning objectives

The aim of the course is to provide students with the fundamental basic knowledge for the study and understanding of administrative law and environmental and landscape legislation.
At the end of the course the student must have the ability to know and critically evaluate the most significant principles and institutions concerning the functioning of the public administration and the main rules dedicated to safeguarding the environment and the landscape in balancing with individual and in particular rights those of health, private property and cultural interest, not without the adequate understanding of the relative historical path.
Based on the information obtained, the student must be able to illustrate his / her thesis with language and arguments appropriate to a legal subject

Course unit content

The course examines the main issues relating to administrative law, in the context of which the scientific disciplinary sector includes both the legal framework of the environment, and that of the landscape as a cultural asset, which therefore refer to two different regulatory groups.
It is necessary to start from the indicated common belonging to the SS10 and therefore it is necessary to study the principles and the most important institutions of administrative law that govern them: the concepts of legality and procedure.
The course will deal with: 1) historical evolution, internal, community and international environmental legislation; 2) administrative organization of the environment and institutional actors that are expression of it; 3) classification and conduct of proceedings of administrative environmental procedures; 4) historical evolution and legal term of the landscape; 5) identification, control and management of landscape assets; 6) planning, sanctions and protection for the landscape as a cultural asset; 7) green public procurement; 8) historical evolution on the regulation of renewable energy sources; 9) Case law on the relationship between landscape and renewable sources; 10) environmental, social and economic sustainability

Teaching methods

The course is taught by lectures and workshops held by another professor.
In this way, students will be able to achieve the educational objectives indicated also through the discussion of themes and cases.

Assessment methods and criteria

Oral examination.
The preparation will be verified by at least two questions to establish the level of learning of the legislation, its historical evolution and its complex relationships with territorial and cultural interests.
The ability to communicate will be verified by evaluating the student's ability to provide exhaustive definitions, to use the appropriate technical terminology and to clarify the meaning of certain expressions.
The final level of learning will be assessed through an overall evaluation of the answers.
the minimum grade (18/30) will be achieved only with the positive outcome of this overall judgment.
