Learning objectives

Knowledge and understanding:
the course aims to provide thorough knowledge of the jurisdictional and non-jurisdictional protection of rights conferred on individuals and collective corporate bodies from European Union law, with particular reference to specific areas of Union action.

Applying knowledge and understanding:
the student will be able to:
- understand the nature and function of the protection mechanisms foreseen by the EU to guarantee the rights;
- verify the effectiveness of these mechanisms of protection in specific areas of EU action;
- seize the increasing impact of EU law within the legal systems of the Member States and the daily lives of EU citizens.

Making judgements:
at the end of the course, the student should have acquired the ability of a critical approach to the sources of European Union law.

Communication skills:
the student will be able to communicate effectively its arguments, using the specific legal language of the discipline.

Learning skills:
the student must have developed a self-study method, fits a legal discipline in constant becoming.

Prerequisites

Students should have previously pass the exam of European Union Law.

Course unit content

The course aims at providing an in-depth knowledge of the means through which individuals (natural or legal persons) or collective corporate body, can enforce the rights conferred on them by EU law, with a special focus on the protection of rights in some areas of action of the European Union.

I) Framework for the subject:
the EU as "Community by law"; the sources of the EU law and the attribution of rights; the ownership of the rights.
II) Protective measures: jurisdictional protection (principle of effective protection; role of the EU Court of Justice; role of national courts; legitimization of individuals and corporate bodies to appeals of EU acts; EU non-contractual liability; compensation for damages by the State from the breach of EU law); no jurisdictional protection (European Ombudsman; right to petition the European Parliament; the SOLVIT service).
III) Analysis of specific areas of protection: the protection of fundamental rights (analysis of the Nice Charter; Opinion no. 2/2013 of the Court of Justice and relations EU / ECHR); the protection of rights related to the internal market (analysis of cases involving the "four fundamental freedoms"; protection of market competition; regulation on state aid; consumer protection; protection of intellectual property - Community trade mark and European patent with unitary effect; Personal Data Protection and Regulation 2016/679/EU); EU citizenship rights protection (Political rights; consular protection pursuant to Directive 2015/637/EU; the right of initiative of EU citizens; case studies); the protection of rights of “non EU-citizens” (immigration and asylum policy; the reform proposals of the European Commission; case studies); analysis of topical subject (Brexit and others).

Bibliography

The methodology of the course and the various subjects examined involve classroom discussion of case studies and consideration of legislation governing specific fields of EU action.
Attending students will take the examination on the basis of lecture notes and the regulatory and jurisprudential material which will be distributed and discussed during the course.

Also non-attending students will refer to the above-mentioned regulatory material available on the platform Elly.

To prepare the examination, will be pointed out to attending students also articles of doctrine and chapters of manuals.

Teaching methods

The lectures - with use of visual aids and slides -will be complemented by the discussion of case studies and the analysis of the legal sources addressed.

Assessment methods and criteria

Oral exam.
The knowledge and understanding will be assessed with some questions to verify the actual knowledge of the study program.
The ability to apply the knowledge and the making judgement will be assessed discussing with the candidate about hypothetical cases.
The communication skills will be assessed by evaluating the mastery of the discipline technical language.
Learning skills will be assessed by a cross evaluation of the answers given by the candidate during the oral exam.
