Learning objectives

The aim of this course is to provide the students with appropriate tools to study and understand the most problematic and current issues of this subject. This will be done not only through the reading of the sources and institutional texts but also through the analysis of legal and doctrinal paths.

I Module - Freedom and organisation of the trade unions <br />
Sources. Trade union pluralism. Freedom of trade unions before the State; and before the employers. The non-use of discriminatory acts. Company unions. The trade union as a non-recognised association. Associationism among employers. Organisational models; confederations and federations. Territorial organisation. <br />

II Module - trade union activity at work <br />
Representation. The most representative trade union, comparatively most representative and most representative. Support legislation. Trade union law in the work place. Article. 19 and the third chapter of the Statute of workers’ rights. Right to information. <br />

III Module Collective bargaining <br />
The common law collective bargaining contract. The parties. The form. Regulatory part and obligatory part. Structure and levels of bargaining. Collective bargaining in the public sector (introduction). <br />

IV Module The efficacy of the collective bargaining contracts <br />
Subjective efficacy. Objective efficacy. Unbreakability Efficacy over time. Relationship between law and collective bargaining contracts. Relationship between different levels of collective bargaining contracts. The principle of favor. <br />

V Module Striking <br />
Article 40 of the Constitution. The concept of strikes. Internal limits. So-called anomalous forms of strike. External limits. Striking in essential public services. Lockouts <br />

VI Module Repressions of anti-union behaviour <br />
The concept of anti-union behaviour. The procedure (ex art. 28 of the Statute of workers’ rights). Contents of the Judge’s order.
