Learning objectives

The course will examine fundamental rules regarding forced execution proceedings (forced expropriation and specific performance), on the basis of the concepts already covered in the courseCivil Judgment Law< /span>. The purpose of the enforceable order is to guarantee that the standards of substantive law are jurisdictionally protected even in the event of lack of spontaneous collaboration by the person bound by them. The goal of the course is to emphasise the close interconnection between substantive law and executive proceedings as a useful subject of in-depth examination, without losing sight of the importance of this subject in a professional sphere.

Prerequisites

Passing the Civil Proceedings Law exam is mandatory for sitting the Civil Judgment Law exam..

Course unit content

<br />The course will examine writ of execution, injunction, foreclosure, creditor intervention, sale and assignment and division. Handing over or release execution and execution of obligation to do or not do, system of oppositions Suspension and extinction of executive proceedings. <br />

The exam will also cover the changes made in the civil proceedings code in laws no. 80 of 14 May 2005, no. 263 of 28 December 2005 and no. 52 of 24 February 2006. <br />
