Integrated course unit module: LEGAL ASPECTS OF THE MANAGEMENT ROLE

Learning objectives

The course aims to provide students with legal principles and normative and doctrinal aspects of specific interest for the practising of nursing/midwifery activities at a managerial level.

Course unit content

<br />Legislative evolution of non medical healthcare professions: current practice of nursing and obstetrics. The ethical code of the nurse and the midwife. Qualifying educational goals of advanced degrees in nursing and obstetric science. Duties and limitations of advanced degree graduates in the professional sphere of nursing and obstetrics. Overview of Public Law and Private Law. Basic concepts regarding the penal code: constituent elements of a crime. Abuse of professional practice, the professional secret, failure to make a referral. Healthcare documentation for which nurses and midwives are responsible. the nursing/midwifery record. Crimes of forgery and fraud in a public document. Register for the signing in and out of narcotics: legislation in force. Birth assistance certificate. Role of the nurse and midwife in health emergencies. Prescribing and administering drugs. The patient/healthcare professional relationship: informed consent. Mandatory healthcare treatment and physical constriction of the patient. Privacy laws: protection of sensitive data. Legislation on the removal and transplantation of organs and tissue: medicolegal aspects. The professional responsibility of the nurse and the midwife as regards penal, civil, and administrative spheres and the medical association. The evolution of the law nursing/obstetric professional responsibility matters. The professional responsibility of the nurse and the midwife in the hypothetical event of indirect fault (due to errors of the “assisting personnel”). Insurance cover for civil professional responsibility.
