Learning objectives

The course sets out to examine in depth a topic of administrative law which because of its concrete relevance makes it possible to combine the study of theory with an assessment of its utility. For graduates specialising in political science such a grasp of law is highly relevant to the occupational profiles that are typical for such as degree.

Course unit content

The course aims to teach students about the administrative regulation of competition protection as set out both in the fundamental law of constitutional importance, Law no. 287 of 1990 (and subsequent amendments) which created the Autorità Garante della Concorrenza e del Mercato (Italian Antitrust Authority) and in European Community Law which it in fact implemented. The study of this subject is of particular interest in that it brings together various disciplines in both the legal field (in particular administrative law) and other fields of knowledge. Therefore its interdisciplinary nature is well suited to the profile of graduates of this course. Finally, the subject chosen lends itself more than others to an assessment of the effectiveness of several concepts which belong to the general theory of administrative law (such as the principle of legality, administrative and technical discretionary power, regulatory powers of independent authorities) in relation to economic innovation, and to ascertaining the “role of the judge in the face of administrative decisions for the operation of the markets”.
