Course unit partition: PRINCIPLES OF PRIVATE LAW

Learning objectives

The course is designed to provide a comprehensive introduction to Italian private law.

Prerequisites

The course is essential for all the other courses, apart from courses of sectors IUS/19 (Storia del diritto italiano), IUS/20 (Filosofia del diritto) and SECS/P01 (Economia politica).

Course unit content

1. Nature of law: concept and classifications. Legal rule and legal system. Sources of private law. 2. Legal relations. 3. Legal subjects. Capacity to have rights and capacity to exercise rights. Natural person and corporate person. 4. Property, the so called "diritti reali", possession. 5. Law of obligations: sources of obligations. Classification of obligations. Performance and other forms of extinction of obligations. Law of contract. Main contracts. 6. Law of torts. 7. Protection of rights. 8. Prescription. 9. Registration.10. Basics of corporate law.

Teaching methods

Oral lesson (80 hours) and exercitations (in the Course of Private law A-L).

Assessment methods and criteria

Oral exam in respect of the whole programme. At least three questions will be put.
