Learning objectives

THE COURSE PROVIDES THE THEORETICAL, CONCEPTUAL AND METHOLOGICAL TOOLS TO ANALYSE THE ITALIAN REGIONALISM. THE AIM OF THE COURSE IS A DEPTH EXAMINATION OF SPECIFIC SUBJECTS RELATING TO THE ORGANISATION AND FUNCTION OF TERRITORIAL AUTONOMIES, ALSO UNDERSTOOD AS PARTICULARLY IMPORTANT DIMENSIONS FOR SOCIAL SERVICES.

Skills and abilities acquired at the end of the course:

- Knowledge of the main models of federalism and regionalism
- Understanding the division of competences between State and Regions through the analysis of the jurisprudence of the Constitutional Court, with particular reference to the integrated system of social services.
- critical analysis of the national legislation relating to territorial autonomy; ability to develop a critical judgment on the case law of the Constitutional Court concerning the relationship between State and Regions.

Course unit content

THE COURSE AIMS TO DESCRIBED THE TRENDS IN THE CURRENT PROCESS OF INSTITUTIONAL REFORM AFFECTING THE CURRENT FUNCTIONAL AND ORGANISATIONAL ORDER OF THE REGIONS AND LOCAL AUTHORITIES, THEIR MUTUAL RELATIONS AND THOSE WITH THE STATE.

THE FIRST SECTION OF THE COURSE WILL BE DEDICATED TO: THE DEVELOPMENT OF REGIONALISM IN ITALY, UP TO THE REFORM OF CHAPTER V OF THE CONSTITUTION INTRODUCED UNDER THE CONSTITUTIONAL LAW N.3 OF 2001; THE CONCEPT OF FEDERALISM AND REGIONALISM.

THE MAIN TOPICS COVERED IN THE SECOND SECTION ARE:- REGIONAL STATUTARY POWER; THE NATURE OF REGIONAL GOVERNMENT AND THE NEW DIVISION OF LEGISLATORY COMPETENCIES BETWEEN THE STATE AND THE REGIONS FOLLOWING THE REFORM OF CHAPTER V OF THE CONSTITUTION; THE PRINCIPLES OF SUBSIDIARITY, APPROPRIATENESS AND DIFFERENTIATION AS CRITERIA FOR DISTRIBUTING; ADMINISTRATIVE COMPETENCIES AMONG THE STATE, REGIONS AND LOCAL AUTHORITIES; FISCAL FEDERALISM; REGIONS, EUROPE AND THE INTERNATIONAL SYSTEM.

Teaching methods

The course will take place mainly through lectures.
In connection with the course programme, seminar programmes and explorations of particularly relevant issues will be organised, with scholars and teachers also from other universities and institutes taking part. Course attendees will be involved in organising these seminars and preparing course materials.

Assessment methods and criteria

Oral examination. Students will be required to demonstrate that they have acquired (a) the knowledge of the fundamental categories concernig theories on federal and regional states; (b) ability to critical analysis of law and jurisprudence that have characterized the development of the italian regionalism.
