Learning objectives

The educational objectives are to enable students, at the end of the
course, to have fully comprehension of the fundamental principles
governing the exercise of the judicial function concerning action of public
administrations and to be able to easily use the reconstructive tools
needed by the correct application of the provisions that govern the
exercise oh this function.
At the end of the course students will have acquired, by virtue of what
has just been stated, independence of judgment in the examination of
concrete issues of administrative procedural law, as well as ability to
articulate with a technically correct language underlying reasoning.

Course unit content

The course aims to provide students with the basic fundamentals of the
italian rules related to tirals against public administration.
The first part of the course is devoted to the description of the general
principles concerning the relationship between the judiciary and
administrative power. It deals, in particular, the issues of legal claims
actionable in court against the public administration and the limits of the
judicial function in respect of the exercise of administrative power.
The second part of the course is entirely focused on the detailed analysis
of the provisions recently introduced into our system by the Code of
Administrative Procedure: we examine all possible judgments which may
be brought before the administrative judge, the forms of their
introduction and discussion, appeals and tools for the enforcement of
judgments.
The third part of the course deals the actions against the public
administration pertaining to different judges from administrative courts
and not-jurisdictional forms of protection.

Assessment methods and criteria

They can be written tests during the course.
Final assessment will consist of an oral examination, divided basically
into three questions, one for each part of the course: questions are aimed
at understanding whether the student has acquired sufficient knowledge
of the fundamental aspects of each party.
